What workers' compensation benefits may I be entitled to receive?

If you have been injured at work or while performing the duties associated with your job, you may be entitled to workers' compensation benefits. The type and amount of benefits that you are entitled to receive will vary depending on the particular case. An injured worker may have the right to the following benefits:

  • Cash benefits - these benefits are not paid for the first 7 days of the disability unless it extends beyond 14 days. Partially or totally disabled claimants who are unable to work for more than 7 days may be entitled to cash benefits, which are calculated based on the claimant's average weekly wages from the previous year and percentage of disability.
  • Medical benefits - an injured worker will be entitled to receive all necessary medical care related to the injury/illness and his or her recovery. Except in emergency situations, the health care provider must be authorized by the Workers' Compensation Board.
  • Supplemental benefits - these benefits are paid to claimants who have been most affected by rising costs. These apply to workers or widows/widowers of workers who were injured or lost their lives prior to January 1, 1979.
  • Social Security benefits - when a worker is disabled for more than 12 months, he or she may be entitled to Social Security benefits. These federal benefits are determined based upon medically determinable physical or mental impairment.
  • Death benefits - if a worker loses his or her life, the surviving spouse and children or other dependents may be entitled to weekly cash benefits. These benefits will equal two-thirds of the decedent's average weekly wage from the previous year before the accident or injury. If the decedent left no children, spouse or other dependants who would be entitled to compensation, the parents or the estate of the decedent may be entitled to a payment of $50,000. In the Bronx and the surrounding metropolitan areas in New York, funeral expenses of up to $6,000 may also be paid.

For example, a claimant whose average weekly wage was $600 and who is completely (100%) disabled would be entitled to $400 per week in cash benefits. If the same claimant was partially (60%) disabled he or she would be entitled to $240 per week.
